Service Description

SwimKeep is a web-based tool for pool owners to track water chemistry, receive recommendations, and access weather-based guidance. SwimKeep stores your pool data locally in your browser and provides optional premium features through annual subscriptions.

No Account Required

SwimKeep does not require user accounts. Simply open the website and start using SwimKeep. Free features work immediately. Premium features require an active subscription managed through email and Stripe.

• No Sign-Up: You do not create a username or password
• No Personal Information Required: Use free features without sharing any information
• Email Optional: Only provide an email if you choose to purchase a subscription
• Browser Data: All your pool data stays in your browser and is under your control

Free Tier

SwimKeep is free to use for basic pool tracking and management:

• Pool Profile: Create and store your pool setup locally
• Chemistry Logging: Record and view your water chemistry readings
• History and Trends: Review past logs and trends in your browser
• Weather Lookup: Get weather forecasts by ZIP code (with daily limits)
• No Limits: Use free features as much as you want

Premium Subscriptions

Premium subscriptions unlock advanced features and higher daily quotas. Annual pricing is $49 for Early Access and $89 for Standard pricing.

• AI Recommendations: Unlimited pool chemistry guidance powered by AI
• Photo Analysis: Upload pool strip photos for automatic chemistry reading
• Higher Quotas: Increased daily limits for weather, photo analysis, and AI features
• Annual Commitment: Subscriptions renew automatically each year
• Email-Based: No account needed - subscriptions are tied to your email for billing purposes

Billing and Subscriptions

Subscriptions are processed through Stripe and managed via email:

• Email Required for Billing: Provide your email at checkout for subscription management
• Annual Renewal: Subscriptions automatically renew on the anniversary of your purchase
• Cancellation: Cancel your subscription through Stripe at any time
• Refunds: No refunds are issued for partial months or years. Cancellations take effect at the end of your billing period.
• Price Changes: We may change pricing with 30 days notice. Existing subscriptions are not affected until renewal.

Feature Quotas

Premium and free tiers have different daily quotas for resource-intensive features:

• Weather Lookups: Free tier has 5 daily lookups per day; Premium has unlimited
• Photo Analysis: Free tier has limited uploads; Premium has 10 uploads per day
• AI Recommendations: Free tier has limited requests; Premium has unlimited
• Quotas Reset Daily: Quotas reset at midnight UTC
• No Carryover: Unused quota does not carry to the next day

Acceptable Use

You agree to use SwimKeep for lawful purposes related to pool care. Prohibited uses include:

• Automated abuse or attempts to circumvent quotas and limits
• Using SwimKeep for any illegal purpose
• Reverse-engineering or attempting to extract our service logic
• Interfering with SwimKeep infrastructure or availability
• Transmitting malware, spam, or phishing content
• Harassment or abusive behavior toward SwimKeep support

Your Data

You own all your pool data. Here is how it works:

• Local Ownership: All pool profiles, chemistry logs, and history stored in your browser are completely yours
• No SwimKeep Copy: We do not store copies of your local browser data on our servers
• Backup Responsibility: You are responsible for backing up your local data. Browser data can be lost if you clear your cache or storage.
• Email as Identifier: When you subscribe, we save your email with your subscription status only
• Deletion: Clear your browser cache to remove all your local SwimKeep data

AI Guidance Disclaimer

SwimKeep provides informational guidance only. AI-generated recommendations can be incorrect, incomplete, or out of date and are not professional advice:

• Not Professional Advice: SwimKeep recommendations are informational only and not a substitute for professional pool service, engineering, or chemical advice
• How It Works: SwimKeep combines your submitted pool profile, readings, recent additions, and weather context to generate guidance
• AI Limits: Responses may miss context, misread intent, or suggest steps that are not appropriate for your exact equipment or chemistry products
• Manuals and Labels First: Always follow your pool equipment manuals and chemical product labels before acting on any recommendation
• Manufacturer Guidance: Use manufacturer-recommended dosing, startup, and safety procedures as your primary source of truth
• Verify Readings: Always verify critical chemistry readings with a professional test kit
• Unsafe Conditions: If water looks unsafe or equipment appears damaged, stop using the pool and contact a professional immediately
• User Responsibility: You assume all responsibility for decisions made based on SwimKeep recommendations
• No Liability: SwimKeep is not liable for damage, injury, or poor pool conditions resulting from using our recommendations

Service Availability and Changes

SwimKeep may change features, quotas, or pricing. We will use reasonable efforts to announce major changes:

• Reasonable Efforts: We will attempt to announce significant changes before they take effect
• No Guarantees: We do not guarantee continuous service availability
• Feature Changes: Features, quotas, or pricing may change without prior notice
• Your Choice: You may cancel your subscription if changes are unacceptable to you

Limitation of Liability

To the maximum extent permitted by law, SwimKeep and its operators are not liable for:

• Indirect or consequential damages from service use or unavailability
• Loss of data, business opportunity, or profits
• Damage to property or personal injury
• Inaccuracy or completeness of AI recommendations or guidance
• Interference with or disruption of the service

Disclaimers

SWIMKEEP IS PROVIDED AS-IS AND AS-AVAILABLE WITHOUT WARRANTIES. SWIMKEEP DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOUR USE OF SWIMKEEP IS AT YOUR OWN RISK.

Termination and Suspension

We may suspend or terminate your access to SwimKeep if you violate these Terms:

• Violation of Terms: We may suspend access if you abuse the service or violate these terms
• Immediate Effect: Suspension may be immediate without notice for serious violations
• Your Data: Your local browser data is always yours; suspension does not affect data stored in your browser
• Appeal: Contact support@swimkeep.com if you believe your access was suspended in error

Governing Law

These Terms are governed by the laws of the State of Texas without regard to conflict of law principles. You agree to exclusive jurisdiction in Texas state and federal courts.

Changes to Terms

We may update these Terms. Material changes will be posted with an updated effective date. Your continued use of SwimKeep after changes means you accept them.
